Breaking: Burress pleas guilty, will serve 2 years in prison
Former New York Giants' WR Plaxico Burress has pled guilty weapons charges in New York and has agreed to a two year prison term.
Former New York Giants receiver Plaxico Burress pleaded guilty to a weapons charge and agreed to a two-year prison term for accidentally shooting himself at a Manhattan nightclub.
Burress pleaded guilty Thursday morning to one count of attempted criminal possession of a weapon, a lesser charge than he initially faced. Under a plea agreement, he agreed to a two-year prison sentence and two years of supervised release.

The unfortunate thing...
Is that people will now feign righteous indignance and ask why Stallworth didn’t receive this sentence, but the situations are completely different. Stallworth’s situation was completely unavoidable (if you read the facts of the case) and the family was only really looking for money. Plaxico’s was entirely avoidable, could have led to death or injury, and ANYTHING involving gun charges is taken extremely seriously in the state of New York. From the very start, Plaxico was going to jail. He thought he could prolong it and play in the NFL one more year, but chances are it wouldn’t have mattered anyway.
stupid justice system
still too harsh of a sentence. wayyyyy too harsh. i know a guy with possesion charges, intent to distribute, bribery, extortion, he even tried to fix hits with an undercover cop. he’s looking at 5 yrs with a plea right now. 5 yrs!!! by comparison to plax he should be getting a lot more, no? if he’s getting 5 yrs, then plax’s sentence is wayyy to much. and i live in texas.

and the state said eff you, we’re taking your guilty ass down. Giving him another plea was a gift. Plax dug his grave, and now he’s got to sleep in it.

i just don’t feel the punishment fits the crime. he had no intentions of violence or shadiness towards anyone, even though what he did was shady. it’s so easy to just throw ppl in prison. i’m sure they could have found a more productive punishment.

Burress should have argued based on Heller. Its not like 2 years in jail isn’t going to ruin his career anyway.
That said, I’m not sorry to see him out of the league given how he hurt the Eagles.

where does it say you can ignore gun control laws in NYC in the constitution? It says you can have a gun, and if he actually registered it where he had it, there wouldn’t be a problem. That wasn’t the case.

I don't think that the Constitution
guarantees anybody the right to discharge a firearm in a crowded night club. Burress is just lucky that the only person hurt was himself. Given that he could have received 3 and a half years, I think the sentence is light.

As a Giant fan, I didn’t want him back anyway after he destroyed our season last year. However, these politicians think nothing about trampling all over our rights guaranteed by the Constitution. To KEEP means to own. To BEAR means to carry. To INFRINGE means to encroach or trespass upon a right or privilege. Pretty easy to understand. The NY handgun law is already working its way through the courts and will be thrown out by the Supreme Court when it gets there. Bloomberg knows this. He doesn’t care.
On the other hand, maybe it is for the best. Just because I don’t want Plax doesn’t mean I want the Eagles to get him.
Constitution has nothing to say about this situation
The 2nd Amendment relates to Militias - it has no relevance whatsoever to personal possesion of firearms.
Of Course It Does
If you look up the word militia in the dictionary, it will say that a militia is a group of citizens who organize in a time of crisis to react to a threat. What our founding fathers were saying in the 2nd Amendment was that if the people do not have an individual right to own firearms, they will not be able to form into militia units to fight an invader. That was exactly what happened in the American Revolution. They were paying homage to the way this country won its independence.
Whether you, or any of the stupid, self-serving politicians or judges understand it or not, we, the people, are the last line of defense.
